Texas Bans Prefilled Disposable Vapes - What You Should Know

On July 2, 2025, Texas passed Senate Bill 2024, which places restrictions on pre-filled disposable vapes made in China or containing Chinese-made e-liquid. This bill was signed by Governor Abbott, and officially takes effect starting September 1, 2025.

 

Why the Law Was Introduced

Originally aimed at banning nearly all vape products “made wholly or partly” in China, intense industry pushback forced a pivot. The final compromise focuses specifically on prefilled disposables originating from China. Meanwhile, refillable devices and U.S.-filled products remain unaffected.

 

What’s Included — and What’s Not

❌ Banned:

• Single-use disposable vapes prefilled in China
• Devices marketed with youth-appealing designs (like candy or toy styles)
• Products containing cannabinoids, kratom, mushrooms, alcohol, or similar additives.

• Refillable vape systems (pods/mods) or disposables with U.S.-filled e‑liquid
• FDA-authorized products filled domestically
• Flavored options remain legal if they avoid youth-appealing shapes and graphics
